Probate does not have to be a time-consuming and complicated matter.  Most estates can be effectively handled through a simple informal probate.

Probate is necessary when there are assets in the decedent's name alone.  Probate requires the Personal Representative to submit the Will for approval with the district court.  The court will issue Letters Testamentary as evidence of the Personal Representative's authority to act on behalf of the estate.

Small estates can be administered through a Small Estate Affidavit which does not require court approval.
